Carefully read these Terms of Use before using this Insurance Sales Platform Service (“Platform”). The user ("you" or “your”) will be subject to the Terms of Use from the first time you login to the Platform and you need to signify your acceptance of the Terms of Use by clicking on the 'I have READ and AGREED to the Terms of Use above and Sign In' button in the Platform. If you do not accept these terms, you should leave the Platform immediately and cease any further use of any materials you have obtained from the Platform.
1. Copyright and Usage of Platform Design
1.1 All content on this Platform including, but not limited to, trade marks, logos and other proprietary images, text, photographs, video and designs (“Platform Design”) is owned by Fidelidade Macau Life — Insurance Company Limited and Fidelidade Macau - Insurance Company Limited (jointly hereinafter referred to as “Fidelidade”, “we”, “us” or “our”), unless otherwise indicated.
1.2 Except as expressly permitted by Fidelidade or applicable laws, uses of the Platform or Platform Design other than Clause 2, including but not limited to, duplication, distribution, re-posting, sending, deleting or editing are strictly prohibited.
1.3 No publication or commercial use of the Platform Design is permitted without the prior written permission of Fidelidade.
1.4 No part of the Platform Design shall be made available as part of another website. This Platform and the Platform Content shall not be stored (in whole or part) in a database of any kind, or used to construct a database.
2. Use of the Platform
2.1 You may access and use the Platform solely to enquire information of insurance proposals and policies, and enable the submission of information ("Online Submissions") in order to handle your customer’s insurance applications and/or policies according to their requests. To this end, you may:
2.1.1 access, retrieve, display on computer screen the content as obtained from the Platform, or enter information, fill in online forms or send Online Submissions ("Platform Content");
2.1.2 enquire information of insurance proposals and policies;
2.1.3 print insurance proposals and insurance applications including any illustration documents, and copies of the Platform Content; and
2.1.4 temporarily store the Platform Content in electronic form.
2.2 You may not use the Platform and/or any part of the Platform Content:
2.2.1 disclose to any unauthorized third party(ies);
2.2.2 to download or upload files or programs (including viruses, worms, corrupt files, trojan horses or similar) that may damage or impair the operation of the Platform, Fidelidade's networks, and/or any other systems or equipment operated or used by Fidelidade;
2.2.3 to use any data mining or similar data gathering and extraction tools;
2.2.4 to distribute or publish any obscene, infringing, blasphemous or unlawful material;
2.2.5 for resale purposes including the extraction and/or re-utilisation of any part of the Platform or the Platform Content;
2.2.6 to download (other than Point 2.1.4 above) or modify the Platform Content or any portion of it;
2.2.7 to interfere with or disrupt any equipment, network or website connected to the Platform or gain unauthorised access to other computer systems; and
2.2.8 for any purpose which is unlawful or contrary to the laws and regulations of the Macau SAR.
2.3 Except as expressly provided in these Terms of Use, using the Platform does not give you permission to link to it or to use any intellectual property rights displayed, used or contained within it.
2.4 You acknowledge and agree that Fidelidade is entitled at any time to stop or cancel your access to, or use of, the Platform with or without giving you any prior notice or warning and for as long as Fidelidade considers necessary.
3. Login and Password
3.1 Fidelidade shall provide you with login and password information which you will need to use to access the Platform. If you need to amend the login and/or password information Fidelidade has provided to you, please contact Fidelidade.
3.2 You shall keep all login and password information relating to your access to the Platform secret at all times and you shall not disclose such login and password information to any person.
3.3 If your login and/or password information is lost, stolen or inoperative, you shall inform Fidelidade immediately, and Fidelidade will issue new login and/or password information to you. Without prejudice to Clause 6.5 of these Terms of Use, Fidelidade shall not be liable for any loss or damage that you or any of your group companies may viruses, worms, cancel bolts, corrupt files, trojan horses or similar).
4. Online Submissions
4.1 If any Online Submission is inaccurate, incomplete and/or does not comply with any Applicable Laws, the Platform may alert you of such inaccuracy, incompleteness or non-compliance and/or may prevent you from submitting your final Online Submission to Fidelidade.
4.2 If it appears to us that any Online Submission as received by us is inaccurate, incomplete and/or does not comply with any Applicable Laws, you must correct all inaccuracies, incompleteness and/or non-compliance.
4.3 You hereby agree that:
4.3.1 it shall at all times be and remain your responsibility to check and ensure that your Online Submissions are complete, accurate and correct;
4.3.2 it shall at all times be and remain your responsibility to comply with all Applicable Laws in relation to the submission of your Online Submissions; and
4.4 You hereby agree that:
4.4.1 Fidelidade may use, reproduce, manipulate, modify, adapt and/or run reports using, any Online Submissions submitted by you (including information and data submitted by you) at any time and for any purpose as Fidelidade may require or otherwise deem necessary; and
4.4.2 Fidelidade owns all intellectual property rights in all works created as a result of any activity carried out by us under Clause 1 of these Terms of Use.
4.5 Fidelidade shall not be held liable for any error or omission committed by you when using the Platform. You are advised to ensure the accurateness, completeness and correctness of all information provided to the Platform and that any transaction or message is performed or received intentionally and correctly.
5. Availability and Connectivity
5.1 Use of the Platform requires internet connectivity and telecommunications links. You are responsible for any costs or charges that you may incur to access, view and/or use the Platform.
5.2 Whilst Fidelidade makes every effort to ensure the Platform is available at all times, given the nature of the internet and communications networks, this may not be guaranteed.
5.3 In addition to other rights of Fidelidade as set out in these Terms of Use, Fidelidade may suspend or restrict access to the Platform to allow Fidelidade or Fidelidade's suppliers to carry out essential updating, maintenance and repairs. In these circumstances, Fidelidade will endeavour to restore your access to the Platform as soon as possible.
5.4 If you are unable to access the Platform, please report it to Fidelidade.
6. Liability
6.1 Given the nature of internet and communication network, errors, delays, incomplete transmission or other circumstances beyond the control of Fidelidade may happen. All records kept and maintained by Fidelidade shall provide final and conclusive evidence of any particular transaction for all purposes.
6.2 We shall not be liable to any person for any kind of loss or damage which may arise from the use or misuse of the Platform or any Platform Content (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill). Nothing in these Terms of Use excludes our liability to you under applicable law.
6.3 You agree to indemnify us from and against any and all losses, damages, costs and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Platform and/or any part of the Platform Content.
7. Third Party Sites
The Platform may include links to third party websites ("Third Party Sites") from time to time. You acknowledge and agree that Fidelidade will not be responsible for the availability of such Third Party Sites and will not be responsible or liable for any Platform Content or services available from such Third Party Sites. You should check the applicable privacy statements and terms and conditions of use for such Third Party Sites as well as the disclaimer which you can view via the Platform.
8. Platform Security
8.1 The Platform will encrypt data during network transmission to protect personal data from unauthorized or accidental access.
8.2 When you access the Platform, our system may log down information from your browser, such as your IP address, access date and time. The purpose of collecting this information is for information security and internal record.
8.3 Although every effort is made to secure network communications, the privacy of online communications cannot be guaranteed, including the potential risks that the data will be seen or used by unauthorised third parties. When using the Platform, you should also take steps to protect personal information, such as closing the web browser when finishing the use of the site; ensuring password(s) are kept securely and not disclosed to anyone else.
9. Alterations to these Terms of Use
We reserve the right at any time to make changes to these Terms of Use. You will be subject to the amended Terms of Use from the time you signify your acceptance of the amended Terms of Use by clicking on the 'I agree to the Terms of Use and Sign In' button in the Platform.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Macau SAR. Any dispute arising from the performance of these terms shall be solved through negotiations. When the same cannot be solved through negotiations, either party may file a lawsuit to a court in Macau SAR.
PERSONAL DATA PROTECTION POLICY
Fidelidade Macau Life — Insurance Company Limited and Fidelidade Macau - Insurance Company Limited (jointly hereinafter referred to as “Fidelidade”, “we”, “us” or “our”) strictly comply with the confidentiality obligations under the Macau SAR Law No. 8/2005 “Personal Data Protection Act” and other relevant law and regulations, and strives to protect the privacy of the data subjects. No data will be disclosed, sold or exchanged to any third party unless consent of the data subject has been obtained or permitted by law.
Fidelidade collects and processes data of data subject under the laws, regulations, supervisory requirements or upon consent of data subject, and will provide the relevant data to the following parties for various purposes as set out below.

3. Purposes and uses of data processing:
a) To analyze statistics, to count and compile the number of browsers and information viewed, so as to understand, ensure and improve the quality of services;
b) To ensure data safety and for security purpose.
4. Recipients of data
a) Fidelidade;
b) Members of the Fidelidade group;
c) Regulatory bodies, Judiciary Police, public entities;
d) Counter parties of Fidelidade in discharging its legal obligations (e.g. any persons, organizations etc.);
e) Counter parties approved by the data subject;
f) Service providers of Fidelidade;
g) Other relevant organizations or persons with confidentiality obligation towards Fidelidade.
5. Rights of the data subject
Under Article 10 to 12 of the Personal Data Protection Act, data subjects have rights including the right to information, right to access, right to make correction and right to object, and such rights may be exercised by filling in the designated forms provided by Fidelidade applied in writing or in a way designated by Fidelidade. Fidelidade may charge a fee for any request to access the data.
6. Record retention
Fidelidade will keep the data until it is no longer necessary to serve the purposes for the collection of such data or upon expiry of statutory limitation of period for such storage.
7. Security of data
Fidelidade protects the personal data of data subject by adopting security technology and management measures for privacy protection and by restricting access so that only authorized users could access, view or process data of data subject.
Fidelidade will take prudent and reasonable measures to protect the confidentiality and security of the data of data subject.
